1. SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale ("GTC") aim to: a) Inform any potential customer ("Customer") of the terms under which the Seller markets and delivers ordered Products. b) Set out the rights and obligations of the parties regarding the sale of Products and Services.

They apply, without restriction or reserve, to all orders for products ("Product(s)") or services ("Services") provided via the website (https://www.boks.app) or any URL administered by the Seller within the boks.app domain.

Please read these GTC carefully. The Seller reserves the right to modify these GTC at any time.


2. PRICE

Prices for Products and Services are stated in Euros, excluding delivery costs. Delivery costs are indicated before order registration and are invoiced separately based on the destination.

Prices include Value Added Tax (VAT) at the rate applicable on the day of the order. Any change in the VAT rate will be automatically reflected in the prices. The Seller reserves the right to modify prices at any time; billing will be based on the prices displayed at the time of order registration.


3. PRODUCT CHARACTERISTICS

In accordance with Article L 111-1 of the French Consumer Code, Customers are invited to consult www.boks.app to review the essential characteristics of the Products before ordering.

Photos, graphics, and descriptions are provided for illustrative purposes only and are non-contractual. The Seller shall not be held liable for any discrepancies.


4. SERVICE CHARACTERISTICS

Services offered for sale are subscriptions under the "PackPRO+" and "PassONE+" offers, the characteristics of which are defined in the General Terms and Conditions of Use.


5. ORDERS

By registering an Order, the Customer acknowledges:

  • Acceptance of these GTC without restriction.

  • Having full legal capacity to enter into this agreement.

  • That the purchase is for strict personal or professional use.

The Seller reserves the right not to validate an order for any legitimate reason, including:

  • Non-compliance with these GTC.

  • Quantities not corresponding to normal consumer use.

  • Ongoing dispute regarding a previous payment.

  • Suspected fraud.

Confirmation and an invoice will be sent via email. Please retain a copy of these documents.


6. PAYMENT

Accepted payment methods (subject to regional availability): Credit/Debit Cards, Stripe, PayPal, Google Checkout, and Checkout by Amazon.

Payment is due at the time of the order. These sums are neither deposits nor advances; the full amount is charged upon order confirmation. The Seller reserves the right to request identity verification for card payments to prevent fraud.


7. CHOICE OF PRODUCTS AND SERVICES

The Customer is solely responsible for choosing Products and Services suited to their needs and ensuring compatibility with their existing equipment.


8. DELIVERY

Products are delivered to the address provided during the order. Upon receipt, the Customer must check the condition of the package and its contents in the presence of the carrier. In case of anomalies:

  1. Follow the carrier's claim procedure (report damage, refuse the goods if necessary).

  2. Inform the Seller immediately, citing the order number.


9. DELIVERY TIMES

Boks parcel boxes are generally delivered within a maximum of 8 weeks following order validation. Late delivery does not entitle the Customer to damages or order cancellation. If a Product is unavailable, the Customer will be informed and refunded within thirty (30) days of payment.


10. QUALITY AND CONFORMITY

Claims for defective or non-compliant Products must be submitted within ninety (90) days of receipt. Failure to comply with this timeframe results in the Products being deemed compliant and free of apparent defects. Contact: help@boks.app.


11. WARRANTY

The Seller guarantees hardware components against defects in materials and workmanship for two (2) years from the date of purchase (the "Warranty Period") for the original purchaser.

  • Wear parts (batteries): Guaranteed for six (6) months.

  • Eligibility: This applies to consumers as defined by European directives.

  • Exclusions: Damage caused by unauthorized modifications, repairs, misuse, negligence, or natural disasters (fire, flood, lightning, etc.) is not covered.


12. PRODUCT AVAILABILITY

Offers are valid while stocks last. If a Product becomes unavailable after an order is placed, the Seller may offer a new delivery date or cancel the order and provide a full refund. Personalized Products (e.g., engraved plates) cannot be returned or refunded.


13. DEFECTIVE PRODUCT CLAIMS

To return a defective Product for exchange or refund, a claim must be submitted within 90 days via:

14. LEGAL RIGHT OF WITHDRAWAL

Pursuant to Article L121-21 of the French Consumer Code, the Customer has fourteen (14) clear days from receipt of the Product (or payment for a subscription) to exercise their right of withdrawal.

  • Exclusion: Does not apply to clearly personalized Products.

  • Condition: Products must be returned in their original packaging, in as-new condition for resale, with all accessories and the original invoice.


15. EXTENDED RIGHT OF WITHDRAWAL (COMMERCIAL GESTURE)

As a commercial gesture, the Seller extends the withdrawal period to ninety (90) days from receipt of the Product.

  • Return Costs: Borne by the Customer.

  • Condition: Products must be in perfect condition for resale. Boks reserves the right to apply a depreciation allowance (up to 100% of the value) if the Product is damaged, incomplete, or the original packaging is deteriorated.


16. SUBSCRIPTION WITHDRAWAL AND MIGRATIONS

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Services fully executed before the end of the withdrawal period.

  • Digital content not supplied on a tangible medium where execution has begun.

The Customer expressly acknowledges that orders for migration services, subscriptions, or digital products (hosting, configuration, etc.) entail immediate execution upon payment and waives their right of withdrawal.


17. REFUNDS

Upon receipt and inspection of the returned Product, Boks will notify the Customer via email. Refunds (minus any depreciation for damage) will be processed within 14 days of receipt of the goods, using the original payment method.


18. LIABILITY

The Seller is not liable for non-performance due to Force Majeure (natural disasters, health crises, strikes, network failures). Liability is limited to direct damages caused by the Seller's proven fault. It does not cover indirect damages or misuse by the Customer.


19. APPLICABLE LAW AND JURISDICTION

Sales are governed by French Law. If an order is for export, the Customer is responsible for complying with local regulations and paying necessary taxes/duties.

Any dispute shall be subject to good-faith negotiation. If no agreement is reached within one (1) month, the Courts of Paris (France) shall have exclusive jurisdiction.


20. DATA PRIVACY

Data collected is essential for processing orders. It is handled in compliance with GDPR (EU 2016/679). Customers have the right to access, modify, and delete their personal data. For details, see the Privacy Policy on the website.
